Posted by: moemebe 1 year, 6 months agoA condominium board on the Upper East Side is asking a judge to stop a newly opened Subway restaurant from baking fresh bread, claiming the building is being "inundated with strong and nauseating food odors," causing property values to plummet.

Only a few years ago the EPA ruled that a Hostess bakery, in the suburbs of Boston, by the way, was emitting unlawful amounts of ethyl alcohol, and other substances in to the air.
Rather than install the necessary scrubbers, the company opted to move....far away from the union employees that worked there, to hire fresh starts.
And if you don't like the smell of Subway, why would you move to the suburbs, where most Subways are located?
Of course, Subway could make an offer to give them all a few free big subs per month, that would quell some of the Plaintiffs.

I said "If you don't like ODORS" I was referring to the many odious smells you have to deal with when you live in a city, I find it humorous that the smell of fresh breads is the "odor" that these kooks find objectionable.

As one who has worked at Subway, there is a VERY bad smell of the Italian bread, BUT I personaly can only smell it on my clothes. I know some friends who can't stand going into a Subway because of the smell while most people, like myself, can't pick up on the smell. Interesting article.

That's the point people who can afford a good lawyer can usually get there way over some one who can't.

i worked in a subway years ago, and theres no way the odors made it to the 46th floor!

I've worked in various malls with restaurants in them. If a restaurant was near my store, it would eventually acquire an odor that is not pleasant. A food born odor is pleasant at first, but when it stays in a closed area it becomes stale. It then attaches itself to the walls and other permanent fixtures just like cigarette smoke. Most buildings have inadequate ventilation systems and will recycle old odors. The restaurant owner is on the right track by offering to install a better ventilation system but it is not going to eliminate the problem. In the condo building the odors are going to get into the places talked about and then build up becoming stale. The odors can travel to the upper floors because of the recycling of the ventilation system. cont

cont These people paid a substantial amount of money for their condo's. They should be able to enjoy their building without the irritation from the restaurant. It is up to the Subway owner to run his business without interfering in the lives of the condo owners. They were there first.
